We
hold that documents generated by the State in connection with its investigation
of compliance by Correctional Medical Services (CMS) with the terms of its
contract with the State, its determination to assess liquidated damages against
CMS, and its computation of such damages are not protected from discovery in a
breach of contract action instituted by CMS by either the deliberative process
or the official information privileges. 05-22-12
